Hotel, Tour Operator or Insurer: Who Should a Foreign Tourist Contact?

After a hotel accident in Turkey, a foreign tourist may be unsure whether to contact the hotel, booking company, tour operator or insurer. These organisations have different legal and commercial roles, and contacting one of them does not necessarily mean that it is responsible.

The first step is often to determine how the holiday was booked and which company actually operated the hotel.

If the Hotel Was Booked Directly

Where the guest booked directly with the hotel, the operating company may be a relevant starting point. The guest should retain:

  • The reservation confirmation;
  • Hotel invoices and payment records;
  • Emails and messages;
  • The hotel’s incident report;
  • The legal name shown on official documents.

The hotel brand and the company operating the property may be different entities.

If the Holiday Was Booked as a Package

Where flights, accommodation or other travel services were sold together, the booking may involve a package travel organiser or intermediary.

The contract should be examined to identify:

  • The organiser and retailer;
  • The included services;
  • Applicable law and jurisdiction provisions;
  • Complaint and notification procedures;
  • The relationship between the organiser and hotel.

The involvement of a tour operator does not automatically make it responsible for every accident. Equally, describing the hotel as an independent supplier may not resolve all legal questions without examining the applicable rules.

What Is the Insurer’s Role?

Several different policies may exist:

  • The guest’s travel insurance;
  • The hotel’s liability insurance;
  • A contractor’s insurance;
  • Coverage arranged by the tour operator.

Travel insurance may cover medical or assistance expenses without determining who caused the accident. A liability insurer’s involvement generally depends on the policy and applicable law.

Can More Than One Party Be Involved?

Potentially, yes. An accident may involve separate issues of hotel operation, building ownership, maintenance or package travel obligations. However, each party’s role must be supported by facts and documents.

Before any formal claim, it may be useful to identify the correct legal entities and preserve the relevant contracts, corporate information and insurance correspondence.
